Winston's Doggy Playhouse Winter 2010 Photo Contest

Participants may enter the program by uploading their photo(s) electronically at Winston's Doggy Playhouse's website (www.winstonsdoggyplayhouse.com) September 30, 2010 through October 26, 2010. Acceptable entries are limited to only original photographs. Graphic designs or illustrations submitted will not be entered.

Once submitted, entries will be judged by a panel of judges from Winston's Doggy Playhouse. Winners will be notified by October 31, 2010 and the winning entries will be announced on the website. One prize will be awarded as follows:

General Steps

  1. Go to Winston's website at www.winstonsdoggyplayhouse.com.
  2. On the home page go to the section about the photo contest.
  3. Click on "Terms and Conditions".
  4. Read the Terms and Conditions and then click I agree.
  5. Upload your photo.

File Format Specifications

  1. Acceptable File formats: JPEG, PDF, TIFF.
  2. File Size: 5 Megabytes maximum
  3. Finished Size: Must be minimum 4" x 6" printed size, high resolution at least 300 dpi.
  4. Photo Enhancements: Limited to color correction only; no digital enhancements to create overlays, collages or montages.

  

  

  

The following CONTEST is VALID in the State of Colorado ONLY. VOID OUTSIDE THE STATE OF COLORADO AND WHEREVER PROHIBITED. Do not enter this CONTEST if you are not a legal resident OF and CURRENTLY RESIDING in the STATE OF COLORADO. Over 18 years or older. THIS CONTEST WILL BE CONSTRUED AND EVALUATED ACCORDING TO U.S. LAW.

OFFICIAL RULES

1. Eligibility: The Winston's Doggy Playhouse "Photo Contest" (the "Contest"), is open to legal residents of the State of Colorado age 18 or older as of date of entry, except employees of Winston's Doggy Playhouse, ("Sponsor"), its affiliates, subsidiaries, distributors, retailers and advertising & promotion agencies, and members of the immediate families or households of any of the above. The contest is subject to all applicable federal, state and local laws and regulations. Void outside the State of Colorado and where prohibited by law.

2. How to Enter: Entry into the Contest begins at 12:00 am EST on September 30, 2010, and ends at 11:59 pm EST on October 26, 2010 (the "Contest Period"). Eligible participants may access Winston's Doggy Playhouse homepage and click on the appropriate icon, and follow the on-screen instructions to upload an original photo and submit an entry during the Contest Period. You must supply all requested information. Photos must be submitted in one of the following formats: JPEG, PDF or TIFF and file size at 5 mega-bytes maximum file size, [but must be available in high-resolution (at least 300dpi) and printable in at least 4" x 6" size]. All entries must be received by 11:59 pm EST on October 26, 2010. Limit one entry per person. If an entrant submits more than one entry, all such entries received from that entrant in that category will be disqualified. All entries become the property of the Sponsor and will not be returned.

3. Conditions of Entry:

  1. Each entry must be created solely by the individual whose name and address appear on the online entry form (the "entrant").
  2. Only one (1) entrant's name may appear on an entry form. No team or group entries allowed.
  3. All entries submitted must be in electronic format (JPEG, PDF or TIFF). Slides, transparencies, prints, videotapes, Polaroid® photographs, are not acceptable formats. Graphic designs and illustrations are not eligible submissions.
  4. Disqualification: Any photograph which Sponsor, in its sole opinion, deems to be indecent, obscene, offensive or otherwise inappropriate for publication will disqualify the entry. Only minor corrections to color and/or sharpness to photos may be made. No other photo modifications are permitted. No digital enhancements to create overlays, collages or montages will be permitted for example but not limited to, photo enhancements or touched-up in any manner whatsoever). Any photograph which is modified or enhanced except as explicitly allowed here will be disqualified and sponsor, in its sole opinion, will decide whether such modifications or enhancements have been made. Sponsor's decisions about disqualification are final.
  5. By submitting an entry each entrant represents and warrants that: (i) his/her photographs are the sole and original creations of the entrant and have not been copied in whole or in part from any other work; (ii) the entry does not violate or infringe any copyright, trademark/trade name, or other proprietary right of any person (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity; (iii) the entry is the sole and exclusive property of the entrant; (iv) neither the entry nor any part of the entry has been published or submitted in any other competition; and (v) the subject(s) and/or persons depicted in any of the photographs or named, described or identified in the essay, have given consent to its submission into the Contest and use as contemplated by these Official Rules.
  6. Do not submit photographs that contain depictions of other third party artistic works, copyrights, trademarks/trade names, logos, or similar brand identifying marks, as entries containing such depictions will be disqualified.
  7. Sponsor may, at its sole discretion, post any entries on the Web Site, but shall be under no obligation to do so. All winning photos may, at Sponsor's sole discretion, be used in Winston's Doggy Playhouse newsletter, e-newsletter and collateral pieces. Each photo used in this manner will be credited to the winner using the winner's name and city/state of residence. Submission of an entry grants sponsor the right to use, publish, adapt, edit and/or modify such entry in any way, in whole or in part, alone or in combination with other works, as solely determined by Sponsor in commerce and in any and all media worldwide, including but not limited to the Website, without limitation or compensation to the entrant and without right of notice, review or approval of any such use of the entry. Submission of an entry further constitutes the entrant's consent to irrevocably assign and transfer to the Sponsor any and all rights, title and interest in and to the entry, including but not limited to all intellectual property rights. By entering, each entrant further warrants and represents that he/she has received all rights which may be necessary from any person or entity depicted in a photograph or named, described or identified in the essay to grant this assignment and transfer of rights.
  8. Upon request of Sponsor, winners shall execute and deliver such additional instrument of assignment as may be deemed necessary by Sponsor in its sole discretion to establish the ownership of record of the right, title and interest in and to the photographs and/or essay and of the intellectual property rights transferred there under. Entries not complying in any way with these Official Rules are subject to disqualification. No correspondence regarding entries will be entered into with entrants except as provided herein.

4. Compliance with Rules / Release. By entering, entrants agree to and acknowledge compliance with these Official Rules, including all eligibility requirements. By entering, entrants further agree to release Sponsor and its affiliates, subsidiaries, divisions, retailers, advertising and promotion agencies, and all of their respective employees, directors, officers, shareholders, agents, successors and assigns (collectively "Releasees"), from any claims, losses, actions, or damages, whether actual, incidental or consequential, arising out of or relating to entrant’s participation in this promotion, or the use or misuse of any prize, or participation in prize-related activities. By accepting prizes, winners grant Sponsor the right to use winners' names, likenesses and biographical information for advertising, publicity, promotional, trade and other purposes in any manner worldwide without limitation or additional compensation, unless prohibited by law. Releasees are further not responsible for injury or damage to entrants' or to any other person's computer related to or resulting from participating in this Contest or downloading materials from, or uploading to, or using the Sponsor's Web Site, generally. In case of dispute, the authorized subscriber of the email account used to enter the Contest at the actual time of entry will be deemed to be the entrant, and must comply with these Official Rules. The authorized account subscriber is deemed to be the natural person who is assigned an email address by an Internet Access Provider, on-line service provider, or other organization which is responsible for assigning email addresses.

Sponsor is not responsible for lost, late, damaged, garbled, misdirected, non-delivered, illegible or incomplete entries, or for entries that are not submitted in accordance with these rules. All such entries will be disqualified. Sponsor is further not responsible for computer system, phone line, hardware, software or program malfunctions, or other errors, failures or delays in computer transmissions or network connections that are human or technical in nature. Sponsor is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Promotion or by any technical or human error which may occur in the transmission, receipt or processing of the entries or for printing errors in these Official Rules or in any advertisements or correspondence in connection with this Contest.

5. Judging: Beginning on or about September 30, 2010, all eligible entries received during the Contest Period will be judged by a panel of qualified judges on the basis of the following criteria, each of equal weight: Originality; Creativity; and Dog Focus. One (1) First Prize, and one (1) Second Prize and one (1) Third Prize will be awarded. (See prize descriptions below).

The judges' decisions shall be final.

6. Prizes:

Total ARV of First Prize package: $61

Total ARV of Second Prize package:$33

Total ARV of Third Prize package: $10

Total ARV of all prizes: $104

7. Notification of Winners: The Prize winners will be notified by e-mail, postal mail and/or telephone following the completion of the judging process, by or about October 31, 2010, and will be required to complete, sign and return an affidavit of eligibility and liability/publicity release (where permitted) within 7 days of initial written notification. Failure to do so will result in disqualification, and awarding of the corresponding prize to an alternate winner on the basis of the criteria set forth herein. If a prize is won by an entrant who meets all eligibility criteria, but is a minor in his/her state of residence, then the prize will be awarded in the minor's behalf to his/her parent or legal guardian, who must sign all required documents.

8. General. Sponsor reserves the right, in its sole discretion, to cancel or suspend this Contest should virus, bugs or other causes beyond the control of the Sponsor corrupt the administration, security or proper conduct of the Conduct and in such case to award the prizes from among all eligible, non-suspect entries received prior to the time of the action or event warranting such suspension or cancellation, provided a sufficient number of qualifying entries have been received by such time.

CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO DISQUALIFY ANY SUCH PERSON AND SEEK DAMAGES FROM HIM/HER TO THE FULLEST EXTENT PERMITTED BY LAW.

9. Prizes Not Transferable. Prizes are non-transferable; no prize substitutions allowed except by Sponsor, who may substitute a prize of equal or greater value if an advertised prize becomes unavailable. All prizes will be awarded provided a sufficient number of eligible entries is received, and prizes are claimed properly in accordance with these rules. Winners are responsible for paying all income tax on all prizes.

11. PRIVACY POLICY: All information collected through registering for the Contest shall only be used in a manner consistent with these promotional Terms and Conditions. False and/or deceptive submissions or acts shall render entrants ineligible. By entering, participant affirms that he/she has read these terms & conditions and meets the eligibility requirements and agrees to be bound by such terms and conditions.
